Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using Case Munshi ("the App," "the Service," or "Case Munshi"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App or Service. These Terms constitute a legally binding agreement between you and Case Munshi.

2. Description of Service

Case Munshi is a legal case management and productivity application designed for Pakistani lawyers, law chambers, and legal professionals. The Service provides tools for tracking hearings, managing cases, recording proceedings, organizing client information, and receiving reminders. Case Munshi is provided on an "as is" and "as available" basis.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account
  • Be at least 18 years of age or the age of legal majority in your jurisdiction

4. User Responsibility

You are solely responsible for:

  • The accuracy of all case data, client information, and hearing dates you enter
  • Verifying court dates, cause lists, orders, and case status independently
  • Complying with all applicable laws, court rules, and professional regulations
  • Maintaining client confidentiality and attorney-client privilege
  • Ensuring your use of the Service complies with your chamber's policies

5. Case Data Entered by Users

All case data, client information, proceedings, and notes entered into Case Munshi are your property. You grant us a limited license to store, process, and display this data solely for the purpose of providing the Service to you and authorized chamber members. We do not claim ownership of your case data.

6. No Legal Advice

Case Munshi does not provide legal advice and does not replace professional legal judgment. The App is a productivity and case-management tool only. Nothing in the App constitutes legal advice, opinion, or recommendation. All legal decisions remain the sole responsibility of the licensed practitioner.

7. No Guarantee of Court Outcomes

Case Munshi makes no representations or warranties regarding case outcomes, court decisions, or legal results. The App does not influence judicial proceedings in any way. Success or failure of any legal matter depends entirely on the merits of the case, the skill of the practitioner, and the decisions of the court.

8. Reminders Disclaimer

Automatic reminders are convenience features and should not be solely relied upon. While we strive to deliver reminders accurately, technical issues, device settings, network problems, or other factors may prevent delivery. Users remain responsible for independently verifying hearing dates, court orders, cause lists, limitation periods, and case status through official court channels.

9. Subscription and Payment Terms

The Basic plan is free. Pro and Chamber Premium plans (when available) will require payment:

  • All prices are in Pakistani Rupees (PKR) unless otherwise stated
  • Subscriptions automatically renew unless cancelled
  • You may cancel your subscription at any time
  • No refunds for partial billing periods
  • We reserve the right to change pricing with 30 days notice

10. Prohibited Uses

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service. Specifically, you may not:

  • Use the Service for any illegal or fraudulent activity
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with other users' accounts or data
  • Upload malicious code, viruses, or harmful content
  • Scrape, crawl, or systematically collect data from the Service
  • Impersonate any person or entity
  • Use the Service to harass, abuse, or harm others

11. Intellectual Property

Case Munshi and its original content, features, and functionality are owned by Case Munshi and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.

13. Limitation of Liability

To the maximum extent permitted by law, Case Munshi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or alteration of your data
  • Missed hearings, deadlines, or court dates
  • Any errors, mistakes, or inaccuracies in the Service
  • Any interruption or cessation of transmission to or from the Service

In no event shall our total liability exceed the amount you paid us (if any) in the twelve months preceding the claim, or PKR 1,000, whichever is greater.

14. Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or factors beyond our control. We are not liable for any loss resulting from Service unavailability.

15. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be notified via email or in-app notice.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict of law provisions.

18. Jurisdiction

Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts at Sialkot, Punjab, Pakistan. You agree to submit to the personal jurisdiction of these courts.
